The Telangana Real Estate Regulatory Authority (TG RERA) has passed strict order in Complaint No. 375/2025. The directive explicitly mandates M/s. Balaji Constructions to complete all pending infrastructure and common amenities for the “Balaji Elegancia” villa project located at Kompally, Medchal-Malkajgiri District, strictly enforcing promoter accountability under the Real Estate (R&D) Act, 2016.
The case was brought forward by the Balaji Elegancia Villa Owners Mutually Aided Co-Operative Maintenance Society Limited, representing residents who had purchased villas based on premium amenities promised in the project’s marketing brochures and agreements of sale. These commitments included a fully functional club house, sewage and water treatment plants, 100% power backup, and extensive security installations. To establish an objective evaluation of the construction status, the Authority commissioned a third-party physical site inspection by the Engineering Staff College of India (ESCI). The expert inspection verified that while multiple villa units were occupied, crucial civic amenities and common recreation systems remained incomplete or severely delayed past the project’s original statutory completion deadline of September 1, 2024.
Exercising its powers under Sections 37 and 38 of the RERA Act, the Authority formally overruled the developer’s preliminary objections regarding the project’s pending extension status and the resident association’s legal standing. The historical ruling underscores that when more than two-thirds of project units are occupied, the developer carries a non-negotiable, non-delegable obligation to deliver all promised aminities and structural infrastructure.
The Authority has directed the respondent developer to complete all pending common amenities strictly within the self-imposed timelines previously committed before the ESCI panel. Crucially, for those infrastructure timelines that have already lapsed, the builder has been given a strict window of 60 days from the date of the order to execute and complete the works.
TG RERA explicitly warned that any failure to adhere to these issued schedules will automatically trigger strict penal prosecution against the promoter under Section 63 of the Act, reinforcing the regulatory body’s dedication to securing consumer protection and driving total market transparency across Telangana.
